Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of proveit's mobile app, website, and related services (the "Service"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and capable of forming a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. The Service

proveit is an accountability platform. You create commitments (such as wake-up times or being at a location). The Service may schedule reminders or system-level alarms and require verification through proof methods (for example cognitive challenges, live selfies, push-up/rep counts via camera and on-device pose detection, GPS within a radius, and location selfies). You cannot mark a commitment complete without required proof.

Features, proof methods, and commitment types may change as we develop the product. Pre-launch waitlist access does not guarantee beta or launch access.

4. Your responsibilities

You agree to: provide accurate account information; submit only genuine proof that you personally performed; not spoof location, use fake or previously captured media as "live" proof, or otherwise circumvent verification; use the Service only for lawful personal accountability purposes; and not harass others or misuse notification/email features.

You understand that missed proofs can result in failed commitments, broken streaks, reduced reliability scores, companion vitality decay, and tone-based notifications (including Direct and Brutal modes you select). Brutal mode is optional tone; it is not personal abuse by another user. You can change tone in Settings.

5. Health and safety

Physical challenges (e.g. push-ups) and wake-up alarms involve physical activity and sleep disruption risk. You are solely responsible for determining whether participation is safe for you. Consult a doctor if you have medical conditions. Do not perform exercises unsafely. proveit is not a medical device and does not provide medical advice.

6. Alarms, permissions, and device limits

Accountability alarms depend on operating-system capabilities, permissions (notifications, exact alarms, full-screen intents, camera, location, etc.), battery optimization settings, and hardware. We do not guarantee that every alarm will fire in all device states. You are responsible for granting required permissions and following device setup guidance we provide.

7. Subscriptions and payments

proveit may offer a free tier (e.g. limited commitments) and paid subscriptions ("Pro") via Apple App Store and Google Play in-app purchase. Billing, renewal, cancellation, and refunds for store purchases are handled by Apple or Google under their terms. Manage or cancel subscriptions in your store account settings. Entitlements may be managed via RevenueCat. Prices and offerings can change; we will communicate material changes as required.

8. Intellectual property

The Service, including software, branding, copy, and design, is owned by proveit or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You retain rights to content you submit (including proof media), and you grant us a worldwide license to host, process, and display that content solely to operate and improve the Service as described in the Privacy Policy.

9. Acceptable use

You may not: reverse engineer or interfere with the Service except as allowed by law; probe or attack our systems; upload malware; attempt to bypass proof verification; use the Service to track others without lawful authority; or use automated means to access the Service in a way that harms performance or integrity.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROOF VERIFICATION WILL BE PERFECT IN ALL CONDITIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, proveit AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

12. Indemnity

You will indemnify and hold harmless proveit from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your proof submissions, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time and may request account deletion through the contact form on our website. We may suspend or terminate access if you violate these Terms, abuse verification, create legal risk, or if we discontinue the Service. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity) will survive termination.

14. Changes to the Terms

We may modify these Terms. We will update the "Last updated" date and may provide additional notice for material changes. Continued use after changes become effective means you accept the revised Terms, except where mandatory law requires other consent.

15. Governing law

These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules. Courts in Ireland have exclusive jurisdiction, except that you may have mandatory consumer protections in your country of residence that cannot be waived.
